Terms of service
Rules for using UGC.Place, a public TikTok UGC creator directory. Not a marketplace, escrow, or TikTok product.
1. Agreement
These Terms of service (“Terms”) govern access to UGC.Place at https://ugc.place and our API. By using the site, creating an account, listing a profile, or buying a sponsor slot, you agree to them. If you accept them for a company or other organisation, you confirm you have authority to bind it, and “you” includes it.
UGC.Place is operated by Hnat Danylevych, a sole trader registered in Poland, NIP 6793354143, [Business address]. “We”, “us” and “our” in these Terms mean that operator and any successor under section 19. Contact: [email protected].
The Privacy policy explains how we handle personal data, including TikTok Login Kit data. These Terms cover the rules.
2. The service
UGC.Place is a free public directory where brands can discover TikTok UGC creators who make software-on-camera content, and where creators can publish a shareable profile. Search is not paywalled.
UGC.Place is not:
- A marketplace, agency, or employer of creators
- A party to any deal between a brand and a creator
- Escrow, invoicing, payroll, or a payment processor for those deals
- TikTok, ByteDance, or an official TikTok product
We may sell a limited number of sponsor placements on the directory (section 7). They never change where a creator appears.
Features launch in stages. Directory cards and metrics labeled illustrative are samples, not live bookings or verified accounts.
3. Eligibility and business use
You must be at least 18 years old to create an account or list a profile. Creators confirm they are 18+ before a listing goes public. The service is not directed at children.
UGC.Place is for professional use: brands use it for their business, and creators use it to offer paid content-creation services, whether or not they are registered as a business. By accepting these Terms, you confirm you use the service for those business or professional purposes. In these Terms you are then a “business user”.
If mandatory consumer law still applies to you, for example as a consumer or as a Polish sole trader for whom a deal is not professional (Art. 385⁵ of the Polish Civil Code), you are a “consumer” in these Terms. Your mandatory rights then prevail, the clauses written for business users do not apply to you, and any clause limiting our liability applies only as far as that law allows.
You may not use the service if applicable law forbids it, or if we have previously closed your account for cause.
4. Accounts
Creators
Creators sign in with Google or with a one-time code or link we email; there is no password. To list, you connect the TikTok account behind your profile through TikTok Login Kit. You must be able to authorize that account, and you must comply with TikTok’s terms while it stays connected. One TikTok account cannot back two UGC.Place users, and an account is one kind: creator or brand.
Brands
Brands, founders, marketers, and agencies may create a thin account in order to contact listed creators, send offers, and save and share creators. Discovery does not require that account. You sign in with Google or with a one-time code or link we email you; there is no password.
Account security
We set an HTTP-only cookie named ugc_session when you sign in. Logout revokes it. Anyone who can read your email or use your Google account can sign in as you, so keep both secure. You are responsible for activity under your login. Tell us at once if you think someone else used your account. We are not liable for loss caused by someone using your email or Google account without your permission, unless we caused it.
Technical requirements
You need a current web browser with JavaScript and cookies turned on to sign in, and an email address. Creators also need a TikTok account.
5. Public listings and your content
Your listing
If you list a creator profile, you make that listing public. Anyone can view it without signing in. You grant UGC.Place a worldwide, non-exclusive, royalty-free license to host, display, cache, and distribute that listing — including your portrait, display name, bio, rates, example videos and their covers, and TikTok numbers — so we can run the directory and related pages (including search and location URLs we may add). You keep ownership of your content.
The numbers on your listing are read from your TikTok account: your follower count, aggregates from a recent sample of public posts, and the view counts of the TikTok videos you choose to show.
What you promise
You confirm that:
- You own, or have a license for, everything you upload or link, including music, footage and logos in your videos
- Every person who can be recognised in your photos and videos has agreed to you showing their image here (Art. 81 of the Polish Copyright Act)
- Your numbers are real: you do not buy or fake followers, views or engagement, and you do not present personal TikTok following as client campaign results
- You add only example videos you made or were credited for, name in “Made for” only brands or apps you made them for, and claim no collaboration that did not happen
- Your listing is accurate, and you keep it that way
Our role
Listings, videos, bios, messages, offers and sponsor cards are the content of the people who add them, and they are responsible for it. We host it. We do not monitor it in general, and apart from the checks in section 6 and section 11 we do not verify it. We act on notices as section 11 describes.
We may refuse, unlist, or remove a listing that breaks these Terms, looks fraudulent, or would make the directory misleading.
6. Messages, offers and shortlists
Messages
A signed-in brand may message a listed creator through UGC.Place, and both sides can then write in that conversation. A message is an introduction. It does not create a contract with us, a booking, or an obligation for the creator to reply or to work. Either side can block the other.
Offers
A brand can send a creator an offer: proposed terms for a paid video. A creator can accept or decline it, and the brand can withdraw it. An offer, and any deal that follows, is between the brand and the creator only. UGC.Place is not a party to it, and is not an agent, employer or escrow for either side. We do not handle payment between you, and we do not guarantee that either side performs, pays, or delivers work of any quality.
We check only what we say we check: that a creator controls the TikTok account behind their listing, and whether a brand’s sign-in email is at its website’s domain. We do not guarantee that anyone is who they say beyond that.
Each side is responsible for its own contracts, taxes and invoices, and for labelling paid content as advertising under the law that applies to it (for example UOKiK guidance in Poland or FTC rules in the US) and under platform rules, including TikTok’s.
Disputes between users
We are not responsible for what other users do: their conduct, their deals, the content they deliver, or whether they pay. We may help with a dispute, but we do not have to. If you are a business user, you release us, as far as the law allows, from claims arising from a dispute with another user, except for harm we cause intentionally.
Saved creators and shortlists
A brand can share a read-only link to its saved creators. Anyone with the link can see the brand name and those creators’ public cards until the brand stops sharing. The brand is responsible for who it shares the link with. Offer templates are private to the brand that saves them.
Do not spam, harass, or scrape profiles in order to contact people off-platform in bulk. We may rate-limit or block contact abuse.
7. Sponsor slots
Advertisers may buy monthly sponsor slots. Slots are sold to businesses. Inventory is limited. Price, duration, and creative approval are described at purchase. Payments for slots are processed by Stripe; they pay for placement on the directory, not for organic creator rank. Refunds are covered in section 8.
Sponsor slots are paid placements, separate from the creator list: they sit in their own rails and strips beside it, look different from creator cards, and link to the advertiser’s site. Payment never changes a creator’s position in the list.
You can buy a slot without an account. After paying you add your card (name, short description, link and logo) through a private link we email you; anyone with that link can change the card until we approve it, so keep it private. You confirm you may use the name, logo and link you submit and let us show them on the directory for the month you bought.
You are responsible for your card, every claim in it, and the site it links to, and for their compliance with advertising and consumer law. Creative must be accurate, lawful, and distinct from creator cards. Our approval does not check your claims. We may reject a card or take it down at any time if it breaks these Terms or the law, without liability beyond the refunds in section 8.
We do not guarantee impressions, clicks, sign-ups or other results. Slot purchase does not make you a partner or give you rights in our mark.
8. Refunds
A sponsor slot is one payment for one calendar month. A person checks your card before the month starts; once it is approved, the slot starts on the 1st and runs to the month’s last day. If we approve it after the 1st, it starts that day and runs to the end of the same month, at the price you paid.
- If we decline your card, or we cannot run your slot, we refund you in full.
- If you cancel before your slot starts, we refund you in full.
- Once your slot has started, we do not refund the time remaining, except where the law requires it.
Consumers: 14 days to withdraw
If you buy a slot as a consumer, or as a sole trader buying for a purpose that is not professional for you (Polish law then gives you a consumer’s rights here), you may withdraw from the purchase within 14 days of paying, without giving a reason. If you buy a slot for a month that starts within those 14 days, you ask us to start it then. If you withdraw after it started, you pay for the days it already ran and we refund the rest.
To cancel, withdraw or ask for a refund, email [email protected] with the email address you paid with. Refunds go back to the original payment method through Stripe, normally within 14 days.
9. TikTok
UGC.Place uses TikTok for Developers products. Login Kit connects a creator’s TikTok account to their profile: user.info.basic (open_id, display name, avatar; never used to sign in) and user.info.profile (your username and profile link). With the scopes you approve on TikTok’s consent screen, Login Kit (video.list) lets us compute aggregate stats from your recent public videos and lets you pick your own videos to show, and user.info.stats reads your follower count. Details are in the Privacy policy.
You agree that:
- Your use of TikTok remains governed by TikTok’s Terms of Service and Community Guidelines
- You will not use UGC.Place to violate TikTok’s rules or to scrape TikTok
- You will not strip watermarks or other copyright notices from TikTok content
- You will not suggest that TikTok publishes, endorses, or operates UGC.Place
- If TikTok revokes our app or your authorization, related features (connecting, reading your numbers) may stop until access is restored
We do not post to TikTok for you. Where offered, we read a sample of the public videos you authorized. Your listing shows aggregates from that sample, plus the videos you choose to show, with their view counts; we do not publish the rest of the list.
10. Acceptable use
You may not:
- Break the law, including IP, privacy, or advertising law
- Post, upload or send content that is illegal
- Upload malware, scrape the directory with bots beyond ordinary search-engine indexing, or overload our API
- Impersonate another creator, brand, or TikTok
- List adult, hateful, or illegal content, or content TikTok would not allow
- Buy, sell, or farm accounts, or circumvent rate limits
- Attempt to extract TikTok tokens, session cookies, or other users’ private data
- Use the directory to spam, phish, or run a pyramid or job-scam scheme
11. Reporting, moderation and complaints
Reporting content
If you are signed in, use Report: on a creator’s profile, for the profile or one of its videos, and in a conversation, for a message, the conversation, an offer you received or the brand that wrote to you. Anyone, with or without an account, can also email [email protected], for example about a sponsor card.
A notice of illegal content should include:
- Where it is: a link, or the profile and which part of it
- Why you believe it is illegal or breaks these Terms
- Your name and email address
- A statement that you believe, in good faith, that the notice is accurate and complete
Reports go to our staff, who look at each one; a report never acts on its own. The person reported is not told about the report or who made it. We do not send reporters an update on the outcome; write to us and we will tell you what we decided.
How we moderate
When content is illegal or breaks these Terms, we may block or remove a message or offer; remove a bio, a “made for” name, a photo, a video or a sponsor card; unlist a profile; pause someone’s messaging; or suspend or close an account.
Automated checks screen messages, offers, report notes, bios, “made for” names, photos and video covers. They can stop or remove that content, and pause messaging for up to an hour after repeated blocked messages (Privacy policy, section 5). Our staff review what the checks flag and what people report, and make every other decision, including removing videos, unlisting profiles and closing accounts.
If we restrict your content or account
When a check stops something you send, you see that it was not sent. A message we remove shows as “Message removed by moderation” to both sides. If staff unlist your profile, your account page says so. When we restrict your content or account (staff remove your content, unlist your profile, or suspend or close your account), we tell you why by email, unless the law forbids it: what we did, why, and which rule we applied. Write to [email protected] to explain your side, and a person will look at the decision again. This does not affect your right to go to court.
Complaints about the service
If the service does not work as these Terms describe, you can complain by email to [email protected]. Include the email you use with UGC.Place (or paid with), what happened and when, and what you would like us to do. We answer by email within 14 days.
Contact point
Our single point of contact for users and for authorities, under the EU Digital Services Act (Art. 11 and 12) and Polish law on electronic services, is [email protected], with [email protected] for questions about the service. We communicate in English and Polish.
If we suspect a crime that threatens someone’s life or safety, we tell the police or other authorities.
12. Intellectual property
UGC.Place, the site design, and our wordmark are ours or our licensors’. You may not copy the service or use our mark in a way that suggests sponsorship.
TikTok names and logos are trademarks of their owners. Any use of those marks is nominative: to describe a connected TikTok account or a linked public video.
Copyright, trademark and image complaints
If you believe content on UGC.Place infringes your copyright, trademark or right to your image, email [email protected] with:
- A link to the content, and which part of it
- The work or mark concerned, and your right in it
- Your name and contact details, and whom you act for
- A statement that you believe, in good faith, that the use is not authorised and that the notice is accurate
We may remove or disable the content and tell the person who added it, who may reply to the same address showing why it is lawful (for example a license). If they do, we may restore it and tell you. Content that lives on TikTok should also be reported to TikTok. We close the accounts of users who infringe repeatedly.
Feedback and usage data
We may use any feedback or ideas you send us freely, without payment or credit. We may use anonymised, aggregated data about how the service is used, which does not identify you, to run, improve and describe it.
13. Disclaimers
The service as is
The service is provided “as is” and “as available.” We do not warrant that listings are complete, that a creator or brand is trustworthy, or that contact will lead to work. We may change, suspend or remove features at any time. We do not guarantee uptime: the service may be interrupted for maintenance, faults or reasons beyond our control.
Illustrative profiles, sponsor names, and placeholder metrics are labeled as such and are not offers.
To the fullest extent allowed by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement and, for business users, statutory warranty for defects. We do not warrant uninterrupted or error-free operation. Some places do not allow these disclaimers; in those places they apply only as far as local law allows.
Numbers and results
TikTok numbers come from TikTok. They can be incomplete, delayed or wrong, and they are a snapshot of a sample of public posts, not an audit of a creator’s whole career or of any brand campaign. They are information, not a promise of reach, views, sales or other results. Do not rely on them alone for a business decision. We are not responsible for TikTok’s data.
Services we rely on
UGC.Place depends on services we do not control: TikTok, Google sign-in, Stripe, Cloudflare, our email and moderation providers, and the players that play videos inside the page. We are not responsible for their availability, their changes or their acts. If one of them cuts or changes our access, for example if TikTok revokes our app, the features that depend on it may stop, without liability on our part.
14. Limitation of liability
Business users
If you are a business user, to the fullest extent the law allows, UGC.Place and its operator, Hnat Danylevych, are not liable to you, in contract, tort or otherwise, for indirect or consequential loss, or for lost profits, revenue, data, goodwill or deals, arising from the site, a listing, a message, an offer, an ad, or the services in section 13.
Our total liability to you for all claims relating to the service is limited to the greater of the amounts you paid us in the 12 months before the claim arose, and PLN 500.
These limits do not apply to harm we cause intentionally (Art. 473 §2 of the Polish Civil Code), to death or personal injury, to fraud, or where other mandatory law does not allow them.
Consumers
If you are a consumer, the limits above do not apply to you. Nothing in these Terms limits your rights under mandatory consumer law, or our liability for harm we cause intentionally or through gross negligence.
Events beyond control
Neither you nor we are liable for a failure or delay caused by events beyond reasonable control, such as outages of internet, hosting or other providers, cyberattacks, power failures, natural disasters, epidemics, war, strikes, or acts of authorities.
15. Indemnity
If you are a business user, you will indemnify us against claims by others, fines, damages and reasonable legal costs that arise from:
- Your content, including your listing, videos, messages, offers, and your sponsor card and the site it links to
- Your deals and disputes with other users
- Claims that your content infringes copyright, trademark or image rights
- Your duties to label paid content as advertising and to pay your taxes
- Your breach of these Terms, of TikTok’s terms, or of the law
We will tell you about the claim promptly, and you will cooperate with us. We may take over the defence, and you may not settle a claim against us without our consent. This does not apply to the extent we caused the harm ourselves. Consumers are not bound by this section.
16. Suspension and deletion
You may stop using the site at any time. You can delete your account yourself in your account settings: the Account tab, Delete account. If you cannot sign in, email [email protected] from the account’s email address and we will delete it for you. Deleting an account deletes the TikTok tokens we hold for it, as described in the Privacy policy.
We may restrict or suspend an account, unlist a profile, or refuse service if you break these Terms or the law, if the law requires it, if we reasonably suspect fraud or a risk to someone’s safety, or if TikTok shuts off our app access. On the same grounds we may close an account. When we restrict your content or account we tell you why by email, as section 11 describes. We may stop offering the service.
License to your public listing ends when the listing is removed, except for copies already made (search-engine caches, backups in rotation) and records we must keep.
17. Changes
We may update these Terms, for example when the service, the law or our business changes. We post changes here with the new date, and give reasonable notice of material changes by email where we have your address. If you do not agree, stop using the service and delete your account. If you keep using the service after a change takes effect, the new Terms apply. Visitors without an account are bound by the version posted when they use the site.
Current version: 29 October 2026.
18. Governing law
These Terms are governed by the laws of Poland, excluding conflict of law rules. If you are a business user, the common court for the operator’s registered place of business in Poland has exclusive jurisdiction over disputes, except that we may seek injunctive relief in any forum to protect the service or intellectual property.
If you are a consumer, this does not take away the protection of the mandatory laws of the country where you live, or your right to bring proceedings there.
19. General
- These Terms, with the terms shown at checkout when you buy a sponsor slot, are the whole agreement between you and us about the service.
- If a clause is invalid, the rest stays in force, and the clause is replaced by the valid one closest to its purpose. For consumers, an invalid clause simply does not apply.
- If we do not enforce a right at once, we have not waived it.
- We may transfer these Terms and your account to a successor of the business, including a company the operator forms or a buyer of the business. We will tell you by email; your rights under these Terms stay the same, and you may delete your account. You may not transfer your account or these Terms without our written consent.
- We send notices to the email address on your account, or the one you paid with.
- Sections 12 to 15, 18 and 19 survive the end of our agreement, as do the release in section 6 and the license in section 5 as far as section 16 says.
- The English version of these Terms governs. If we provide a Polish version and there is doubt, a consumer may rely on the version more favourable to them.

Privacy policy
This page describes how UGC.Place works. It is not legal advice. If a mandatory consumer or privacy law in your country gives you rights this page does not list, those rights still apply.
